Why End Adverse Possession Now?

 

Some would argue that because adverse possession has been around since the Middle Ages, it must be a sound legal principle.

 

This argument fails for the same reason legalized slavery failed. Just because a law has been in existence for hundreds of years, it does not mean that today that law is good, moral or needed.

 

Others would argue that adverse possession has a useful purpose in that it benefits communities.

 

This argument stems from an old English land use theory that posits those who use land should be rewarded.

 

Unfortunately, this theory has been perverted by land developers, greedy neighbors and lawyers who believe using land entitles them to taking land. Clearly, this argument is only supported by self-centered, economic gain.

 


Gone are the days of the Wild West. With today's GPS technology and accurate land surveying equipment, there is no excuse for "accidentally" putting a fence up on another's property.

 

We have recording systems and deeds that accurately depict legal boundaries. As recorded, what one purchases should be exactly what they get. It is fair; it is the American way.

 

Why End Adverse Possession Now?

For a multitude of economic, social, moral and legal reasons, adverse possession needs to end now.
